The abbreviated style of this suit is: JOSEPH M. BROOKS, Executor of the Estate of Sarah Sue Brooks Dorton, and JOSEPH M. BROOKS, Individually v. LESLIE ALICE SIMPSON, et als., including PARTIES UNKNOWN.

The object of this suit is to partition, and if appropriate, sell at public auction, the real property consisting of Lots Numbered Ten and Eleven of Block Six of Keystone Coal & Iron Company's Plat One of the Town of Appalachia, Wise County, Virginia, which plat is of record in the Wise County Circuit Court Clerk's Office, and identified in the Complaint as Tax Map Nos. R018041 and R018039 (the "Subject Property"); to determine the respective rights and interests of the parties in the Subject Property; to distribute the net proceeds of sale according to the parties' respective ownership interests, subject to any liens or other rights determined by the Court; and to appoint a guardian ad litem for all persons made parties by the general description of "Parties Unknown," as appropriate.

It appearing by Affidavit filed according to law that the named Defendants listed below are nonresident individuals of the Commonwealth of Virginia, and that their last known post office addresses are as stated below, it is ORDERED, pursuant to Va. Code § 8.01-316(A)(1), that the said nonresident Defendants appear on or before the 28th day of August, 2026, which date shall be no sooner than fifty (50) days after entry of this Order, and do what is necessary to protect their interests in this suit:

It further appearing from the Complaint and Affidavit filed in this matter that there are or may be persons whose names are unknown who are interested in the Subject Property and/or the subject matter of this suit, and that such persons have been made parties defendant by the general description of "Parties Unknown," namely: ANY PERSON WHO IS AN HEIR, DEVISEE, OR SUCCESSOR IN TITLE TO ANY DEFENDANT NAMED HEREIN, AND/OR ANY OTHER PERSONS WHO MAY, BY VIRTUE OF INHERITANCE, INTESTACY, CONVEYANCE, TRANSFER OR OTHERWISE, HAVE AN INTEREST IN THE PROPERTY, OUTCOME OR SUBJECT MATTER WHICH IS THE SUBJECT OF THIS SUIT, WHO, IF NOT OTHERWISE NAMED HEREIN, ARE HEREBY MADE PARTIES HERETO BY THE GENERAL DESCRIPTION PARTIES UNKNOWN, it is ORDERED, pursuant to Va. Code § 8.01-316(A)(2), that the Parties Unknown appear on or before the 28th day of August, 2026, which date shall be no sooner than fifty (50) days after entry of this Order, and do what is necessary to protect their interests in this suit.

It is further ORDERED that this Order of Publication be published once each week for FOUR (4) successive weeks in the Coalfield Progress, a newspaper of general circulation designated by the Clerk for Wise County, Virginia; that a copy of this Order be posted at the front door of the courthouse wherein this Court is held; and that a copy of this Order be mailed to each of the above-listed nonresident Defendants at the post office addresses stated herein, all pursuant to Va. Code §§ 8.01-316 and 8.01-317.
